Penn National Gaming (PENN: 44.75 -1.65%) has responded to the Maryland Lottery Commission over the recent complaint that they have violated state rules governing casino operations.

Last month rival developer Cordish Cos. asked the Lottery to fine Penn National for their role in supporting a coalition that was attempting to block them from building the state’s largest slots parlor at the Anne Arundel Mill Mall.

Penn National Gaming now managing partner of the Maryland Jockey Club has defended its support of the coalition as free speech.

“Referendum-related activities are highly-protected, core political speech,” said Penn National attorneys.

Penn National Gaming is just weeks away from opening Maryland’s first slots parlor in Perryville and has made its intentions clear that if Cordish Cos. does not win at the polls, they were prepared to bid on a gaming operation at neighboring Laurel Park racetrack.

The Lottery Commission is expected to hear the complaint on September 16.
