Wynn Resorts (WYNN) Disputes Claims from Investment Firm
Wynn Resorts Ltd (WYNN: 88.84 +0.48%) is disputing a claim from Atlantic-Pacific Capital Inc that they are owed money for participating in Wynn’s initial public stock offering for its Macau gaming operations.
APC has attempted to gain payment of $32 million of the capital raised by Wynn Macau’s IPO, despite Wynn’s claims that they had nothing to do with raising the money.
Earlier this month Wynn filed a lawsuit in the Clark County District Court in Las Vegas, arguing that while the company was hired to raise money for an investment vehicle for the purpose of acquiring interests in gaming and hospitality assets or related securities, their contract did involve any of Wynn’s ongoing projects or interests.
“Atlantic-Pacific (APC) never presented Wynn Resorts with any investors and/or capital for Wynn Macau Ltd.,” the lawsuit says.
However on Monday, attorneys for APC moved the lawsuit to U.S. District Court in Las Vegas and filed a demand for arbitration of the dispute.
Wynn contents that “Without relief from this court, Wynn Resorts could be forced to arbitrate a dispute that is not subject to arbitration under rules wholly inappropriate for this dispute” the filing said.
